Trust Registration in Chhattisgarh: Step-by-Step Guide

If you are planning to start an NGO, a school, an old-age home, or any charitable project in Chhattisgarh, registering a trust is usually the first real step. It is also one of the most common questions we get from people in Raipur, Bilaspur, Bhilai, Durg, and smaller towns across the state: “How do I actually register a trust here, and what does it cost?”

This guide answers that in plain language. No heavy legal jargon, just what you need to know before you start.

What Is Trust Registration in Chhattisgarh?

Trust registration in Chhattisgarh means creating a written document called a trust deed, which lays out the purpose of your trust, who the trustees are, and how the trust will be managed. This deed is then registered at the Sub-Registrar's office in your district.

A trust is one of three common legal structures used to start an NGO in India, the other two being a society and a Section 8 company. Trusts are popular because the process is relatively simple and the running costs are low.

There are two broad types of trusts:

    • Private trust – set up to benefit specific individuals, like family members, and not eligible for most government tax benefits.
    • Public charitable trust – set up for a charitable or religious purpose that benefits the public, such as education, healthcare, or poverty relief. This is the type most NGOs choose, because it qualifies for income tax exemptions under Sections 12A and 80G.

Private trusts across India, including Chhattisgarh, are governed by the Indian Trusts Act, 1882. Public trusts in most states, including Chhattisgarh, also rely on this same Act, since the state does not have a separate Public Trusts Act of its own (unlike Maharashtra and Gujarat, which follow the Bombay Public Trusts Act, 1950).

Why Register a Trust Instead of a Society or Section 8 Company?

This is one of the first questions every founder asks us. Here is a quick, honest comparison.

    Choose a trust if:

    • You want a simple, low-cost structure to start with.
    • You are working alone or with a small, trusted group (minimum 2 trustees, though most experts recommend at least 3 for smoother governance).
    • You do not need a large, membership-based structure.
    • You want to begin charitable work quickly without too much paperwork.

Choose a society or Section 8 company if:

    • You expect a larger, more democratic membership structure (a society needs at least seven members).
    • You plan to scale into a more formal, corporate-style NGO.
    • You want a structure that is easier to convert or restructure later.

There is no universally “right” answer. It depends on your goals, the people involved, and how you plan to grow. A quick conversation with someone who has set up multiple NGOs can save you months of rework later.

Documents Required for Trust Registration in Chhattisgarh

Keeping your documents ready in advance makes the whole process faster. Here is what you typically need:

    • Trust deed, drafted on the correct stamp paper, stating the trust's name, objectives, and rules
    • PAN card of the settlor and all trustees
    • Aadhaar card or another valid ID proof (Voter ID, Passport, or Driving License) of the settlor and trustees
    • Address proof of the settlor and trustees
    • Passport-size photographs of the settlor and trustees
    • Proof of registered office address of the trust, such as a utility bill, rent agreement, or NOC from the property owner
    • Two witnesses with their ID proof, required at the time of signing the deed

If any of your documents are unclear or inconsistent (for example, an address mismatch between Aadhaar and a rent agreement), it is worth fixing this before submission. Small errors like this are a common reason for delays.

Step-by-Step Trust Registration Process in Chhattisgarh

    1. Step 1: Choose a Suitable Name

Pick a name for your trust that does not already belong to another registered entity and does not violate the Emblems and Names (Prevention of Improper Use) Act. The name should reflect your trust's purpose where possible.

    2. Step 2: Decide the Objectives and Draft the Trust Deed

This is the most important part of the whole process. The trust deed should clearly mention:

      • Name and address of the trust
      • Objectives (educational, charitable, religious, etc.)
      • Names, addresses, and details of the settlor and trustees
      • Rules for appointing, removing, and replacing trustees
      • Powers and duties of trustees
      • Procedure in case the trust needs to be dissolved

A vague or poorly drafted trust deed can create problems years later, especially when applying for 12A, 80G, FCRA, or CSR-1 registration. It is worth getting this reviewed by someone experienced in NGO law rather than copying a generic template.

    3. Step 3: Get the Deed on Stamp Paper

The trust deed needs to be executed on non-judicial stamp paper. The stamp duty value depends on the trust property's value and Chhattisgarh's applicable stamp duty rates.

    4. Step 4: Sign Before the Sub-Registrar

The settlor and trustees need to sign the trust deed in the presence of the Sub-Registrar, along with two witnesses. This usually happens in person at the Sub-Registrar's office in the district where the trust's registered office is located.

    5. Step 5: Submit the Application and Pay the Fee

Along with the signed deed, you submit the required application form and registration fee at the Sub-Registrar's office.

    6. Step 6: Receive the Registration Certificate

Once the Sub-Registrar verifies everything, your trust is officially registered, and you receive a certified copy of the registered trust deed. In Chhattisgarh, this process typically takes anywhere from 8 to 20 working days, depending on the workload at your local Sub-Registrar's office.

How Long Does Trust Registration Take in Chhattisgarh?

Most trust registrations in Chhattisgarh are completed within 8 to 20 working days from the date of submitting a complete application. The exact timeline depends on how quickly your documents are in order and how busy the local Sub-Registrar's office is that month.

    What Comes After Registration?

Getting your registration certificate is a big milestone, but it is really just the starting point. Most trusts also need:

    • PAN card for the trust, since this is required for almost everything that follows
    • Bank account in the trust's name
    • NGO Darpan registration through the NGO Darpan portal, run by NITI Aayog, which gives your trust a Unique ID needed for many government grants and schemes
    • 12A registration, which exempts the trust's income from tax
    • 80G registration, which lets your donors claim a tax deduction on their donations
    • CSR-1 filing, if you want to receive funds from corporate CSR budgets

Many founders assume registration is the finish line, but in practice, it is the first of several steps needed before a trust can comfortably raise funds and operate with full credibility.

    Common Mistakes to Avoid

    • Drafting the trust deed without clearly defined objectives, which can cause issues later during 12A and 80G applications
    • Choosing trustees without discussing roles, decision-making, and succession in advance
    • Forgetting to keep the registered office address proof updated
    • Treating registration as a one-time task instead of the start of an ongoing compliance journey
    • Skipping professional review of the deed to save a small upfront cost, then facing larger costs to fix errors later

A Few Honest Thoughts Before You Begin

Setting up a trust is exciting. You have a cause you care about, and registration feels like turning that intention into something real. At the same time, it is worth slowing down just enough to get the trust deed, trustee structure, and documentation right the first time.

We have guided many founders across Chhattisgarh through this exact process, and almost every difficult situation we have seen later traces back to a rushed step at the very beginning, an unclear objective clause, a missing document, or a trustee arrangement nobody had really thought through.

If you are still working out the right structure for your idea, or simply want a second opinion before you sign anything, our team at SAI NGO & Business Consultancy is happy to walk through your specific situation with you. There is no pressure either way. Sometimes a short conversation is all it takes to avoid a costly correction later.

    Frequently Asked Questions

Registration is not legally compulsory for every private trust, but it is essential for any public charitable trust that wants tax exemptions, government recognition, CSR funding, or the ability to legally enforce its trust deed in court.
A trust legally needs a minimum of one settlor and two trustees. Most experts recommend at least three trustees for better governance and decision-making, especially if you plan to apply for 12A, 80G, or FCRA later.
There is no fixed minimum capital requirement under the Indian Trusts Act, 1882. Trusts can be formed with a nominal corpus, sometimes as low as a few thousand rupees, since the focus is on charitable activity rather than capital size.
A trust cannot be directly converted. Generally, a new entity is formed, and assets are transferred through proper legal procedures, which can be more time-consuming than getting the structure right at the start.
Trust registration happens at the office of the Sub-Registrar in the district where the trust's registered office is located, such as Raipur, Bilaspur, Durg, or Bhilai.
It is not a strict legal requirement, but most founders prefer professional help for drafting the trust deed and managing the registration process, since errors at this stage can affect tax exemptions and funding eligibility later.
